The Company's total aggregate liability for any claim arising from the services shall not exceed the amount actually paid by the Client to the Company during the one (1) month immediately preceding the event giving rise to the claim. Services are provided on an "as is" and "as available" basis.

8.Indemnification

The Client agrees to indemnify, defend, and hold harmless the Company from and against any claims, damages, liabilities, or expenses (including reasonable attorneys' fees) arising from: (a) content, claims, or materials the Client approves for publication; (b) the Client's products or services; or (c) the Client's breach of these Terms or violation of any applicable law or third-party right.

The Company may update these Terms from time to time. The "Effective Date" above reflects the most recent revision. Material changes will be posted on this page, and continued use of the services after such changes constitutes acceptance of the revised Terms.

10.Governing Law & Jurisdiction

These Terms shall be governed by, construed, and enforced in accordance with the laws of the State of California, USA, without regard to conflict-of-law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Sacramento County, California.
